Twenty4club AG is the operator and provider of the Zenmove Studio Stauffacher and the associated services.
The T&Cs apply to the use of the Zenmove Studio Stauffacher and to OnLive training sessions (in any locations) and are an integral part of the contract and binding for all subscribers.
2. Subscriptions (“Subs”)
2.1 The subs are personal and non-transferable and give the right to book personal training sessions either in the Zenmove Studio Stauffacher or via the OnLive tool.
2.2 Subscribers must be at least 14 years old, with written permission provided by a person with parental responsibility.
2.3 Each subscriber has the right to a trial session.
3.1 The Zenmove Studio Stauffacher, including its OnLive tool, makes its premises and facilities available during opening hours and supervised hours. Use of these is limited to the duration of the subscription. Subscriptions are not extended automatically.
3.2 Various services and subscriptions are offered. The offer depends on the individual contract. All additional services offered are not included in the subscription amount.
3.3 Due to limited places in the training sessions, participation cannot be guaranteed. It is necessary to book a training session (online or in the studio).
3.4 Training sessions take place during the publicised opening hours of the Zenmove Studio Stauffacher.
3.5 Sessions can be cancelled free of charge up to 24 hours before the session (online or in the studio). After that, sessions can only be cancelled by contacting the studio (via LiveChat, phone or email) and a processing fee of CHF 10 will be charged. If the session is not cancelled in time, it will be calculated at the usual rate.
4. Training in the Zenmove Studio Stauffacher Zurich
4.1 The introductory training session may only be done by/with a Zenmove coach.
4.2 Personal training sessions may only be done by/with Zenmove coaches.
5. T&Cs, Instructions
By paying a subscription and using the offer of the Zenmove Studio Stauffacher and/or OnLive training sessions, a subscriber accepts these T&Cs and commits to complying with them and with the instructions given by the staff.
The subscription amount must be paid upon agreeing or extending the contract (via PayPal, credit card, Twint or cash), online or in person at the Zenmove Studio Stauffacher.
7.1 The use of the premises and facilities of the Zenmove Studio, and participation in the Zenmove training sessions and events, is done at your own risk and peril; this also applies to the OnLive training sessions (at home, in the office or anywhere via Skype). The liability of Zenmove and its personnel is therefore waived to the extent permitted by law. In particular, any liability for damage that arises out of violations of the T&Cs or instructions given by the staff is excluded. The subscriber is responsible for taking out insurance.
7.2 Twenty4club AG is not liable for the loss of effects, valuables, money, clothes, etc. It also does not accept any liability for items that are left behind. The subscriber is responsible for taking out insurance.
8. Opening Hours
The Zenmove studio is open during the published opening hours with the exception of public holidays and possible maintenance periods (approximately 1 week/year). The offer and opening hours may change at any time. In the event of closures for operational reasons and/or changes to the offer or opening hours, there is no entitlement to recompense or an extension of the subscription.

10. Use and Interruptions (“Timestop”)
10.1 Non-use of the Zenmove training sessions does not entitle the subscriber to a reduction or reclaim of the subscription amount.
10.2 Where good cause is shown, a subscription may be interrupted for the duration of at least 1 month (“timestop”), but there is no entitlement to this. A request for a timestop must be submitted in writing before the absence, together with the corresponding confirmation/report. A retroactive timestop is only possible in the event of illness/accident. This must be submitted within the first month in the form of a medically certified inability to train. Any submissions after this time can no longer be considered. A timestop can also be granted in the event of an overseas posting, holiday, illness, accident, pregnancy and maternity leave as well as military and civilian national service.
Serious or repeated violations against the T&Cs, the fair play rules or the instructions given by staff can lead to the issuance of a ban. There is no entitlement to a refund of the subscription amount. In the event of violations, the company reserves the right to press charges.
12. Contract Duration, Notice Period
12.1 The contract duration depends on the subscription and expires at the end of the contract term without notice.
12.2 Any withdrawal during the subscription period and corresponding refunds can only be granted in cases of hardship such as chronic illness, accident or definitive change of domicile. The subscription must be submitted together with a written request for refund and the necessary confirmations such as a medical certificate, employer’s report, proof of residence, etc. The repayment of the membership will be done on a pro rata basis minus CHF 20.00 for administrative costs.
13. Data Protection
Any transfer of data to external service providers in Switzerland or overseas is done exclusively in compliance with the strict contractual data protection requirements, due to legal requirements of the law enforcement authorities or if the transfer is necessary to safeguard and implement the legitimate interests of Twenty4club AG.
14. Changes to the T&Cs
The subscriber expressly acknowledges that the company reserves the right to change the T&Cs and that any changes will be notified in the appropriate way. The subscriber cannot derive any rights from this.
15. Applicable Law and Jurisdiction
All legal relationships arising from the present contract are subject to Swiss law. The place of jurisdiction is Zurich.
