GTC
1. Scope of validity
Zenmove AG is the operator and provider of Zenmove Studio Stauffacher and the associated services.
The GTC apply to the use of the Zenmove Studio Stauffacher and for OnLive training sessions (at any location) and are an integral part of the contract and binding for every subscriber.
2. Memberships („Subscriptions“)
2.1 Subscriptions are personal and non-transferable and entitle the holder to book personal training sessions either at Zenmove Studio Stauffacher or via the OnLive tool.
2.2 Subscribers must be at least 14 years old, the consent of a parent or legal guardian is required and must be submitted in writing.
2.3 Every subscriber is entitled to a paid trial training session.
3. Offer
3.1 Zenmove Studio Stauffacher, including OnLive-Tools, shall make its equipment and facilities available during opening hours and supervised hours. Use is limited to the duration of the subscription. Subscriptions are not automatically renewed.
3.2 Various services and subscriptions are offered. The offer depends on the individual contract. All other services offered are not included in the subscription fee.
3.3 Due to limited places in the training courses, participation cannot be guaranteed. It is necessary to book a training session (online or in the studio).
3.4 Training sessions take place during the publicised opening hours of Zenmove Studio Stauffacher.
3.5 Appointments can be cancelled free of charge up to 24 hours before the appointment (online or in the studio). After that, a cancellation can only be cancelled by contacting the studio (via LiveChat, telephone or e-mail) and a processing fee of CHF 10 will be charged. Without timely cancellation, the appointment will be charged properly.
4. Training session at Zenmove Studio Stauffacher Zurich
4.1 The introduction to training is only permitted by/with a Zenmove coach.
4.2 Personal training sessions may only be conducted by/with Zenmove coaches.
5. GTC, Instructions
By paying for a subscription and using the services of Zenmove Studio Stauffacher and/or OnLive Training, a subscriber accepts these GTC and undertakes to comply with them and to follow the instructions of the staff.
6. Payment
The subscription fee must be paid when signing or renewing the contract (via Paypal, credit card, Twint or in cash), online or in person at Zenmove Studio Stauffacher.
7. Liability
7.1 The use of the facilities and equipment of the Zenmove Studio, as well as participation in Zenmove training sessions and events, is at your own risk and peril; this also applies to OnLive Training (at home, in the office or anywhere via “Skype”). The liability of Zenmove and its personnel is excluded to the extent permitted by law. In particular, any liability for damages resulting from violations of the GTC or instructions of the staff is excluded. The subscriber is responsible for taking out insurance.
7.2 Zenmove AG shall not be liable for the loss of personal effects, valuables, money, clothing, etc.. Likewise excluded is any liability for items deposited at the entrance. The subscriber is responsible for taking out insurance.
8. Opening hours
The Zenmove Studio is open during the published opening hours with the exception of public holidays and possible revisions (approx. 1 week/year). The offer and opening hours may change at any time. There is no entitlement to a refund or extension of the subscription due to operational closures and/or changes to the offer or opening hours.
9. Cessation of operations
There is no entitlement to a refund or renewal of the subscription if the service is cancelled.
10. Utilisation and deposit (“Timestop”)
10.1 Non-use of the Zenmove training programme does not entitle the customer to a reduction or refund of the subscription fee.
10.2 If there is a valid reason, a subscription can be cancelled for a period of at least one month. (“timestop”), whereby there is no entitlement to this. A request for a time stop must be submitted in writing before the absence, together with a corresponding confirmation/certificate. A retroactive timestop is only possible in the event of illness/accident. This must be applied for in the first month after the medically certified inability to train. Applications submitted after this date can no longer be considered.
11. Violations
Gross or repeated violations of the GTC, the fair play rules or the instructions of the staff may result in a ban from the premises. There is no entitlement to a refund of the subscription fee. In the event of violations, criminal charges are expressly reserved.
12. Duration of contract, cancellation
12.1 The contract term depends on the subscription and simply expires after the contract expires without cancellation.
12.2 Cancellation during the subscription period and corresponding refunds can only be granted in cases of hardship such as prolonged illness, accident or a permanent change of domicile. The subscription must be submitted together with a written request for reimbursement and the necessary confirmations such as a doctor’s certificate, employer’s confirmation, proof from the residents’ registration office, etc. The repayment of the membership is made “pro rata temporis” less CHF 20.00 for administrative expenses.
13. Data privacy
Data will only be passed on to external service providers in Switzerland or abroad under strict, contractual data protection conditions, to law enforcement authorities on the basis of statutory provisions or if disclosure is necessary to protect and enforce the legitimate interests of Zenmove AG.
14. Changes to GTC
The subscriber expressly acknowledges that changes to the GTC are reserved and that these will be brought to his attention in an appropriate form. The subscriber cannot derive any rights from a change to the GTC.
15. Applicable law and place of jurisdiction
All legal relationships arising from this contract are subject to Swiss law. The place of jurisdiction is Zurich.
