GTC's

1. Scope of application

Zenmove AG is the operator and provider of the Zenmove Studio Stauffacher and the related services.

The GTC apply to the use of the Zenmove Studio Stauffacher and to OnLive Trainings (at any location) and are part of the contract and binding for each member.

2. Memberships 

2.1 Memberships are personal and non-transferable and entitle the member to book personal training sessions either at the Zenmove studio Stauffacher or via the OnLive tool. 

2.2 Members must be at least 14 years of age, and parental consent is required and must be provided in writing.

2.3 Every member is entitled to a trial training.

3. Offer

3.1 Zenmove Studio Stauffacher including OnLive-Tools make their facilities and equipment available during opening hours and supervised hours. Use is limited to the duration of the membership. Membership do not renew automatically.

3.2 Different services and memberships are offered. The offer depends on the individual contract. All other services offered are not included in the membership fee. 

3.3 Due to limited places in the trainings, participation cannot be guaranteed. Booking of a training is necessary (online or in the studio).

3.4 Trainings take place during the published opening hours of the Zenmove Studio Stauffacher.

3.5 Appointments can be cancelled free of charge up to 24h before the appointment (online or in the studio). After that, cancellations can only be made by contacting the studio (via LiveChat, phone or email) and a handling fee of CHF 10 will be charged. Without timely cancellation, the appointment will be charged properly.

4. Training at Zenmove Studio Stauffacher Zurich

4.1 Training introductions are only permitted by/with a Zenmove Coach. 

4.2 Personal Trainings may only be conducted by/with Zenmove Coaches.

5. General Terms and Conditions, Instructions

By paying a membership and using the services of Zenmove Studio Stauffacher and/or OnLive Trainings, a member accepts these GTC and agrees to abide by them and to follow the instructions of the staff. 

6. payment

The membership fee is payable upon conclusion or renewal of the contract (via Paypal, credit card, Twint or in cash), online or in person at Zenmove Studio Stauffacher.

7. Liability 

7.1 The use of the facilities and equipment of the Zenmove Studio, as well as the participation in the trainings and events of Zenmove is at your own risk, this also applies to the OnLive Training (at home, in the office or anywhere via "Skype"). The liability of Zenmove and its staff is excluded to the extent permitted by law. In particular, any liability for damages resulting from violations of the GTC or instructions of the staff is excluded. It is the responsibility of the member to take out insurance. 

7.2 Zenmove AG shall not be liable for the loss of effects, valuables, money, clothing, etc.. Also excluded is any liability for items deposited at the entrance. It is the member's responsibility to take out insurance.

8. Opening hours

The Zenmove Studio is open during the published opening hours, with the exception of high holidays and possible revisions (approx. 1 week/year). The offer and the opening hours can change at any time. Closures due to operational reasons and/or changes in the range of services or opening hours do not entitle the customer to a refund or to an extension of the membership. 

9. Cessation of operations

A discontinuation of service does not entitle the user to a refund or to an extension of the membership.

10. Use and Deposit 

10.1 Non-use of Zenmove Training does not entitle the User to a reduction or refund of the membership fee.

10.2 If there is a valid reason, a membership can be interrupted for a period of at least 1 month ("Timestop"), but there is no right to do so. A request for a timestop must be submitted in writing before the absence, together with a corresponding confirmation/certificate. A retroactive timestop is only possible in case of illness/accident. This must be applied for in the first month after medically certified inability to train. Applications submitted later cannot be considered.

11. Offences

Gross or repeated violations of the General Terms and Conditions, the Fair Play Rules or the instructions of the staff may result in the issuance of a house ban. There is no right to reimbursement of the membership fee. In the event of violations, the right to file criminal charges is expressly reserved.

12. Duration of contract, termination

12.1 The duration of the contract depends on the membership and simply expires without notice after expiration of the contract.

12.2 Cancellation during the membership period and corresponding refunds can only be granted in cases of hardship such as long-term illness, accident or definitive change of domicile. The membership must be submitted together with a written request for refund and necessary confirmations such as a doctor's certificate, employer's confirmation, proof from the Residents' Registration Office, etc. The refund must be made in writing. The refund of the membership will be made "pro rata temporis" less CHF 20.00 for administrative expenses.

13. Data protection

Data will only be passed on to external service providers in Switzerland or abroad under strict, contractual data protection conditions, to law enforcement authorities on the basis of legal regulations or if a transfer is necessary to protect and enforce the legitimate interests of Zenmove AG.

14. Changes to GTC

The member expressly acknowledges that the GTC are subject to change and that these will be brought to his attention in an appropriate form. The member may not derive any rights from an amendment to the GTC.

15. Applicable law and place of jurisdiction

All legal relationships arising from this contract are subject to Swiss law. The place of jurisdiction is Zurich.
